Terms of Service

Welcome to MoLan! These Terms of Service ("Terms") govern your access to and use of the MoLan mobile application, website, and real-time AI character voice chat services (collectively, the "Services"), provided by MoLan ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately stop using the Services.

IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER (SECTION 10). BY ACCEPTING THESE TERMS, YOU WAIVE YOUR RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

1. Eligibility and Age Requirements

1.1 General Audience: The Services are intended for a general audience. You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to create an account and use the Services.

1.2 Mature/NSFW Content Gate: Certain features, storylines, or character interactions may contain mature or Not Safe For Work (NSFW) content. To access this content, you must explicitly opt-in and confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction).

1.3 Misrepresentation: Falsifying your age to bypass age gates is a strict violation of these Terms and will result in the immediate and permanent termination of your account, IP block, and forfeiture of any active subscriptions.

2. Purchases, Virtual Currency, and Subscriptions

2.1 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

2.2 Virtual Currency: MoLan operates using a mixed monetization model. You may purchase a limited, personal, non-transferable, non-sublicensable, revocable license to use virtual, in-app currency ("Virtual Currency") through single transactions.

  • No Real-World Value: Virtual Currency is digital content designed solely for use within the Services. It is not real money, has no monetary value, and cannot be redeemed, cashed out, or exchanged for "real world" money, goods, or services from MoLan or any other party.
  • Loss of Currency: If your account is terminated or suspended for a violation of these Terms, all Virtual Currency associated with your account will be immediately forfeited without compensation.

2.3 Subscriptions: In addition to single transactions, MoLan offers recurring subscriptions that provide a periodic refill of Virtual Currency and access to other premium perks. By subscribing, you agree to pay the fees displayed at checkout. Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date. You may cancel your subscription at any time through your account settings or the applicable app store (e.g., Apple App Store, Google Play), and you will retain access to your subscription perks until the end of your current billing period.

2.4 Payments and Non-Refundable Policy: All payments for Virtual Currency and Subscriptions are processed by secure third-party payment processors. All sales are final. Except as strictly required by applicable law, all purchases of Virtual Currency and Subscriptions are strictly non-refundable. We do not provide prorated refunds for partial subscription periods or unused Virtual Currency.

2.5 Price Changes: We reserve the right to adjust the pricing for Virtual Currency, Subscriptions, and related perks at any time. Any price changes to your ongoing subscription will apply to the next billing cycle after you receive notice of the change.

3. Acceptable Use and Zero-Tolerance Content Policy

To maintain compliance with app store guidelines, payment processor regulations, and local laws, MoLan strictly prohibits certain types of content. You are solely responsible for your conduct and the text or voice content you generate, type, or speak.

3.1 Zero-Tolerance Prohibited Conduct: You agree not to use the Services to generate, promote, or distribute any of the following. Violation of these rules will result in an immediate, permanent ban without appeal:

  • Child Exploitation: Child Sexual Abuse Material (CSAM), grooming behavior, or any content that sexualizes minors or characters depicted with child-like features, regardless of their stated fictional age.
  • Non-Consensual Content: Content depicting non-consensual sexual acts, dubious consent, or "revenge porn."
  • Incest: Sexual content depicting blood-related family members.
  • Real-Person Deepfakes: Generating misleading synthetic media, deepfakes, or impersonations of real, private, or public individuals without explicit, verifiable consent.
  • Violence and Self-Harm: Extreme gore, bestiality, promotion of self-harm, suicide, eating disorders, or terrorism.
  • Hate Speech: Harassment, discrimination, or threats of violence against real people or protected groups.
  • Illegal Activities: Using the Services to plan or facilitate illegal acts, or to provide unlicensed medical, legal, or financial advice.

3.2 AI Service Limitations: MoLan provides AI-generated entertainment. The AI characters are fictional. You acknowledge that generative AI can produce unpredictable, inaccurate, or unintended responses ("hallucinations"). You agree that you will not rely on MoLan for any professional, medical, or psychological guidance.

4. Intellectual Property and User Content

4.1 Your Ownership: When you create original custom AI characters, storylines, or prompts ("User Content") using our tools, you retain ownership of the original text you provide.

4.2 License to MoLan: By creating, publishing, or interacting with characters on the Services, you grant MoLan a worldwide, non-exclusive, royalty-free, perpetual, transferable, and sublicensable license to host, copy, display, distribute, modify, and use your User Content to operate the Services, promote the platform, and allow other users to interact with your creations.

4.3 Popular Content Preservation Clause: If a Character or Storyline you create and set to "Public" reaches a significant level of community engagement (e.g., over 10,000 unique user interactions), MoLan reserves the right to preserve that Character or Storyline and keep it active on the Services indefinitely. You grant us an irrevocable license to maintain this popular content for the continuity of the community, even if you subsequently delete your account or request the removal of your profile.

4.4 AI Model Training: As detailed in our Privacy Policy, we use anonymized text transcripts of your interactions to train and improve our AI models. We never use your original voice audio recordings to train our models. Voice audio is retained for a maximum of 24 hours strictly for debugging and technical reliability purposes before being permanently deleted.

5. Third-Party Services and Infrastructure

MoLan utilizes industry-leading external APIs for Automatic Speech Recognition (ASR), Large Language Models (LLM), and Text-to-Speech (TTS) to power real-time voice features. We reserve the right to rotate, change, or update these third-party providers at any time without notice to optimize performance. MoLan is not liable for service interruptions, latency, or outages caused by these third-party infrastructure partners.

6. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. MOLAN IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE SECURE, UNINTERRUPTED, OR FREE OF ERRORS OR AI INACCURACIES.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOLAN, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID TO MOLAN IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless MoLan and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

9. Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction.

10. Dispute Resolution, Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

10.1 Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively by binding, individual arbitration and not in a court of law. The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration hearing shall take place in Boston, Massachusetts, or at another mutually agreed location.

10.2 Class Action Waiver: YOU AND MOLAN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

10.3 Right to Opt-Out: You have the right to opt-out of this arbitration agreement within thirty (30) days of your first use of the Services by emailing us at the address provided below with the subject line "Arbitration Opt-Out."

11. Changes to These Terms

We may modify these Terms at any time to reflect changes to our business or the law. If we make material changes, we will notify you by updating the "Last Updated" date at the top of this document and providing notice through the Services. Your continued use of MoLan after the changes become effective constitutes your binding acceptance of the updated Terms.
